The CFTC cannot evaluate the margin requirements, settlement procedures, or liquidity implications of each variant separately. The regulator is forced to accept a black box. Smaller DCMs or foreign decentralized platforms like Polymarket, which operate outside the CFTC's direct reach, will simply ignore the letter and continue offering unregulated prediction markets. The regulatory stack trace shows that the burden falls on the regulated, not the underground. More importantly, this move does nothing to address the technical risks that are far more dangerous than procedural shortcuts. Polymarket, the largest decentralized prediction market, runs on Polygon smart contracts without self-certification. Its risks are code bugs, oracle manipulation, and front-running—not template filings. The CFTC's laser focus on certification processes diverts attention from the actual attack vectors in the ecosystem.
